သင်္ဘောကျင်းလုပ်ငန်း လုပ်ကိုင်ခွင့်လိုင်စင် ထုတ်ပေးခြင်း

ဝန်ဆောင်မှု ရယူရန် အခြေခံ လိုအပ်ချက်များ

၁။       ဤ လုပ်ငန်းလုပ်ကိုင်ခွင့် လိုင်စင် ရရှိသည့် ကုမ္ပဏီ/ အဖွဲ့အစည်း/ လုပ်ငန်းရှင်များသည် ယင်း လိုင်စင်အား  အခြားတစ်ဦးဦးသို့ ထပ်ဆင့် လွှဲပြောင်း လုပ်ကိုင်စေခြင်း မပြုရ။

၂။       လုပ်ငန်းလုပ်ကိုင်ခွင့်လိုင်စင် ရရှိထားသူသည် နိုင်ငံတော်၊ ပြည်ထောင်စုဝန်ကြီးဌာန၊ တိုင်းဒေသကြီး/ ပြည်နယ်အစိုးရနှင့် မြန်မာ့ဆိပ်ကမ်းအာဏာပိုင်တို့မှ ပြဋ္ဌာန်း ထုတ်ပြန်ထားသည့် တည်ဆဲဥပဒေ၊ နည်းဥပဒေ များ၊ အမိန့်နှင့် ညွှန်ကြားချက်များကို တိကျစွာ လိုက် နာရမည်။

၃။       သင်္ဘောကျင်းလုပ်ငန်း လုပ်ကိုင်ခွင့်လိုင်စင် လျှောက် ထားသည့်အခါတွင်ဖြစ်စေ၊ လိုင်စင် သက်တမ်း တိုးမြှင့်သည့် အခါတွင်ဖြစ်စေ၊ တစ်နှစ်လျင် သတ်မှတ် လိုင်စင်ကြေးအဖြစ် တပြိုင်တည်း လွန်းတင်နိုင်သည့် ရေယာဉ်စုစုပေါင်း တန်ချိန် ၅၀မှ ၂၀၀၀ အထိ  ကျပ် တစ်ဆယ့်ငါးသိန်း၊ တန်ချိန် ၂၀၀၁ မှ ၁၀၀၀၀ အထိ ကျပ် သုံးဆယ်သိန်းနှင့် တန်ချိန် ၁၀၀၀၀ အထက် ကျပ် လေးဆယ့်ငါးသိန်းကို ပေးသွင်းရမည်။

၄။       သင်္ဘောကျင်းလုပ်ငန်း လုပ်ကိုင်ခွင့် လိုင်စင် သက်တမ်းမှာ (၁)နှစ်ဖြစ်ပြီး သက်တမ်း မကုန်ဆုံးမီ (၃၀) ရက်အတွင်း သက်တမ်းတိုးမြှင့် ဆောင်ရွက်ရမည်။

၅။      သင်္ဘောကျင်းလုပ်ငန်း လိုင်စင်သက်တမ်းတိုး လျှောက်ထားသည့်အခါ၊ မူလ ထုတ်ပေးထားသည့် လိုင် စင်ကို တင်ပြရမည်ဖြစ်သည်။ လိုင်စင် သက်တမ်းတိုး ခြင်းအား အချိန်မီ ဆောင်ရွက်ခြင်းမပြုဘဲ သတ်မှတ် ရက်ထက် ၁လ (ရက်ပေါင်း ၃၀)အတွင်း  ကျော်လွန်ပက ဒဏ်ကြေးအဖြစ် ကျပ် တစ်သိန်း၊ ၁လ(ရက် ပေါင်း ၃၀)ထက် ကျော်လွန်ပါက ကျပ် နှစ်သိန်း၊ ၂လ  (ရက် ပေါင်း ၆၀)ထက် ကျော်လွန်ပါ က ကျပ် သုံးသိန်း၊ ၃လ (ရက်ပေါင်း ၉၀)ထက် ကျော်လွန်ပါက ကျပ် တစ် ဆယ်သိန်းနှင့် ၄ လ (ရက်ပေါင်း ၁၂၀) ထက်  ကျော် လွန်ပါကလိုင်စင်အပြီး ပိတ်သိမ်းခြင်း ခံရမည်။  သက် တမ်း မကုန်ဆုံးမီ ထုတ် ပေးထားသည့် လိုင်စင်ပျက်စီး ပျောက်ဆုံးသဖြင့် အသစ် လျှောက်ထားခြင်း အတွက် ဒဏ်ကြေးအဖြစ် ကျပ် တစ်သိန်းပေးဆောင်ရမည်။

၆။      သင်္ဘောကျင်းလုပ်ငန်းလိုင်စင်မရှိဘဲ လုပ်ငန်း ဆောင် ရွက်ပါက မြန်မာ့ဆိပ်ကမ်းအာဏာပိုင်၏ တည်ဆဲ ဥပဒေနှင့် အညီ ထိရောက်စွာ အရေးယူခြင်းခံရမည်။

၇။      ဤလုပ်ငန်းလိုင်စင်အရ ခွင့်ပြုထားသော လုပ် ငန်းမှအပ အခြားလုပ်ငန်းများ လုပ်ကိုင် ဆောင်ရွက်ခွင့် မရှိ။

၈။      လုပ်ငန်းလိုင်စင်တွင် ခွင့်ပြုထားသည့် ရေယာဉ် အရွယ် အစား၊ တန်ချိန်နှင့် လုပ်ငန်းပမာဏအပေါ် မူတည် ၍ ကိုက်ညီ သည့် အဆောက်အအုံများ၊ စက်ပစ္စည်း စက်ယန္တရားများ ပြည့်စုံ လုံလောက်စွာ ထားရှိရမည်။

၉။      သင်္ဘောကျင်းလုပ်ငန်း ဆောင်ရွက်ကြသည့် အင် ဂျင်နီယာများ၊ ကျွမ်းကျင်လုပ်သားများသည်  အလုပ် သမား၊ လူဝင်မှုကြီးကြပ်ရေးနှင့် ပြည်သူ့အင်အား ဝန် ကြီးဌာန၊ မြန်မာနိုင်ငံအင်ဂျင်နီယာကောင်စီ၊ လုပ်ငန်း ကျွမ်းကျင်မှုနှင့် ပတ်သက်၍ သက်ဆိုင်ရာ အာဏာပိုင် အဖွဲ့အစည်းများမှ ပြဋ္ဌာန်းထားသည့် ဥပဒေ၊ နည်း ဥပဒေများနှင့်အညီ လိုက်နာ ဆောင်ရွက်ရမည် ဖြစ်သည်။

၁၀။    လွန်းကျင်းကြံ့ခိုင်ရေး၊ လွန်းတင် လွန်းချသည့် ရေယာဉ်များ ထိခိုက်မှု အန္တရာယ်မရှိစေရေးအတွက် လုပ်ငန်း လိုင်စင်ရယူသူမှ တာဝန်ယူရမည်။

၁၁။    လွန်းကျင်းမျက်နှာစာရှေ့ ရေပြင်၌  သတ်မှတ်  ရေ အနက်ရရှိရေးနှင့်  သင်္ဘောကျင်း ဧရိယာရှိ  ကမ်းပါးနယ် အတွက် လုပ်ငန်းလိုင်စင်ရယူသူမှ  အမြဲစစ်ဆေး ထိန်းသိမ်း ရမည်။

၁၂။     လွန်းတင် လွန်းချသည့် ရေယာဉ်များကြောင့် မြစ် အတွင်း ရပ်နား ခုတ်မောင်း သွားလာနေသည့် ရေ ယာဉ်များ၊ မြစ်ကူးတံတား၊ ဆိပ်ခံတံတား၊ ဗော်ယာများ ထိခိုက်မှု မရှိစေရေး၊ ရေလမ်းကြောင်း ပိတ်ဆို့မှု မရှိစေရေးကို လုပ်ငန်းလိုင်စင်ရယူသူမှ ကြိုတင်စီစဉ် ဆောင်ရွက်ရမည်။ လွန်းတင် လွန်းချသည့် အချိန်တိုင်း အရေးပေါ် လိုအပ်က အသုံး ပြုနိုင်ရန် တွဲ/ဆွဲရေယာဉ် စီစဉ်ထားရှိရမည်။

၁၃။    လွန်းတင် လွန်းချသည့် ရေယာဉ်များမှ ရေဆိုး၊ ဆီဆိုး ဆီဟောင်းများ၊ အမှိုက်များ၊ အညစ် အကြေး များကို မြစ်ချောင်းအတွင်း လုံးဝ(လုံးဝ) စွန့်ပစ်ခြင်း မပြုရ။ စွန့်ပစ်ခြင်းကို စစ်ဆေးတွေ့ရှိပါက မြန်မာ့ ဆိပ်ကမ်း အာဏာပိုင် ဥပဒေအရသတ်မှတ်ထားသည့်  ဒဏ်ကြေး ပေးဆောင်ရမည့်အပြင် စွန့်ပစ်ပစ္စည်းများ ကို စနစ်တကျ ရှင်းလင်း ဆောင်ရွက် ပေးရမည်။ ထို့အပြင် ရေဆိုး၊ ဆီဆိုး ဆီဟောင်းများ၊ အမှိုက်များ၊ အညစ် အကြေးများကို စွန့်ပစ် ရာတွင် သဘာဝပတ်ဝန်း ကျင် ထိခိုက်မှု မရှိစေရေးအတွက်      လုပ်ငန်းလိုင်စင် ရယူသူမှ  တာဝန်ယူ စီမံဆောင်ရွက်ရမည်။

၁၄။    လွန်းကျင်း လုံခြုံရေးနှင့် မီးဘေးကြိုတင် ကာ ကွယ်ရေးအတွက် လိုအပ်သော အထောက်အကူပြု ပစ္စည်း များ၊ အစီအမံများ ဆောင်ရွက်ထားရှိရမည်။

၁၅။    သင်္ဘောကျင်း ပတ်ဝန်းကျင်ရှိ အများပြည်သူ အား ထိခိုက်နစ်နာစေမည့် လုပ်ငန်း ဆောင်ရွက်မှုမျိုး မရှိစေရန် အထူးဂရုပြုရမည်။ ထို့အပြင် လေထု၊ ရေထု နှင့် မြေထု ညစ်ညမ်းမှုမရှိစေရေးအတွက် လုပ်ငန်း လိုင် စင်ရယူသူမှ တာဝန်ယူ စီမံ ဆောင်ရွက်ရမည်။

၁၆။    ရေကြောင်းပို့ဆောင်ရေး ညွှန်ကြားမှုဦးစီးဌာန၏ ကြီးကြပ်မှုဖြင့် ဆောင်ရွက်သည့် ရေယာဉ် တည်ဆောက် ခြင်း၊ ပြင်ဆင်ခြင်းလုပ်ငန်းများကို ယင်းဦးစီးဌာန၏ သတ်မှတ် ချက်များနှင့်အညီ လိုက်နာဆောင်ရွက်ရမည် ဖြစ်ပြီး International Classification Societies  အဖွဲ့အစည်း များ၏ကြီးကြပ်မှုဖြင့် ဆောင်ရွက်မည့် ရေယာဉ်တည် ဆောက်ခြင်း၊ ပြင်ဆင်ခြင်းလုပ်ငန်းများကို အဆိုပါ အဖွဲ့ အစည်းများ၏ သတ်မှတ်ချက်များနှင့်အညီ လိုက်နာဆောင် ရွက်ရမည် ဖြစ်သည်။

၁၇။    လုပ်ငန်းခွင် အလင်းရောင် လုံလောက်စွာရရှိ ရေး၊ လုပ်ငန်းခွင် ​လေဝင် လေထွက် ကောင်းမွန်ရေး၊ လုပ်ငန်းခွင် သန့်ရှင်းသာယာရေးနှင့် လုပ်ငန်းခွင် ဘေး အန္တရာယ်ကင်း ပစ္စည်းကိရိယာများ စနစ်တကျ အသုံးပြုရေးကို လုပ်ငန်း လိုင်စင်ရယူသူမှ စီမံဆောင် ရွက်ရ မည်။

၁၈။    လုပ်ငန်း ဆောင်ရွက်သည့် လုပ်သားများသည် လုပ်ငန်း အမျိုးအစားအလိုက်ဝတ်ဆင်ရမည့်ဘေးအန္တရာယ် ကင်းဝတ်စုံ၊ အသုံးအဆောင်များ ဝတ်ဆင်ဆောင်ရွက်ရ မည်။

၁၉။    လုပ်ငန်းခွင်ရှိ အဆောက်အအုံများ၊ စက်ပစ္စည်း စက်ယန္တရားများနှင့် လျှပ်စစ်ပစ္စည်းများကို ပုံမှန် စစ် ဆေးပြီး ကြံ့ခိုင်မှုရှိရန်စဉ်ဆက်မပြတ်ထိန်းသိမ်း ဆောင် ရွက်ရမည်။

၂၀။     ကာလအပိုင်းအခြားဖြင့် သတ်မှတ် ထုတ်ပေးထား သည့် လုပ်ငန်းလိုင်စင်၊ ထောက်ခံချက်များကို သက်တမ်း ကျော်လွန်ခြင်း မရှိစေရေးအတွက်ပုံမှန် သက်တမ်းတိုး ဆောင်ရွက်ရမည်။

၂၁။     အထက်ဖော်ပြပါ စည်းကမ်းသတ်မှတ်ချက်များ သည် အခြေခံသတ်မှတ်ချက်များသာ ဖြစ်ပြီး၊ ကာလ/ ဒေသ အလိုက်ထုတ်ပြန်သည့် ညွှန်ကြားချက်များ၊ သင်္ဘော ကျင်းလုပ်ငန်းနှင့် ဆက်နွယ်သည့် အာဏာပိုင် အဖွဲ့အစည်း တစ်ခုခုမှ ထုတ်ပြန်သည့် ညွှန်ကြားချက်များ၊ သတ်မှတ် ချက်များကို လိုက်နာ ဆောင်ရွက်ရန် တာဝန် ရှိသည်။

၂၂။      အထက်ဖော်ပြပါ စည်းကမ်းသတ်မှတ်ချက်များကို လိုက်နာရန် ပျက်ကွက်ခြင်း၊သို့မဟုတ် သင်္ဘောကျင်း လုပ်ငန်း ဆောင်ရွက်နိုင်သည့် အခြေအနေနှင့်ကိုက်ညီမှု  မရှိခြင်းကို တွေ့ရှိပါက သင်္ဘောကျင်းလုပ်ငန်း လုပ်ကိုင် ခွင့် လိုင်စင် ပိတ်သိမ်းခြင်းခံရမည် ဖြစ်သည်။

တန်ချိန် ၅၀မှ ၂၀၀၀ အထိ  ကျပ် တစ်ဆယ့်ငါးသိန်း၊ တန်ချိန် ၂၀၀၁ မှ ၁၀၀၀၀ အထိ ကျပ် သုံးဆယ်သိန်းနှင့် တန်ချိန် ၁၀၀၀၀ အထက် ကျပ် လေးဆယ့်ငါးသိန်း

၃။       သင်္ဘောကျင်းလုပ်ငန်း တည်နေရာ၊ အကျယ်အဝန်း နှင့် သင်္ဘောကျင်းမြေဧရိယာအတွင်းရှိလွန်းကျင်း၊ အလုပ်ရုံ၊ သိုလှောင် ရုံ၊ရုံးစသည့်အဆောက်အအုံများ၏ နေရာချမှု ပုံစံ (Layout Plan)၊

၄။       သင်္ဘောကျင်းလုပ်ငန်း မြေနေရာရှိ မြစ်ရေနှင့် ထိတွေ့ သည် မူလ ကမ်းပါးနယ် (ကမ်းပါးစောက်/ ဆင်ခြေ လျော ကမ်းပါးမြေ)မှ မြစ်ဘက်သို့ ထွက်နေသည့် အဆောက် အအုံများဖြစ်သည့် လွန်းကျင်း အစိတ်အပိုင်း၊ ရေယာဉ်များ ယာယီဆိုက်ကပ်ရန် ထားရှိသော တံတား၊ ယာယီကြိုး ချည်စင် စသည်တို့၏ အတိုင်းအတာ၊ ကမ်းပါးနယ်မှ ကျွံထွက်လာသော အဆောက်အအုံအတွက် အကွာအဝေး ပါရှိသည့် နေရာချမှုပုံစံ (Layout Plan) နှင့် တည်ဆောက် ထားသည့် ဒီဇိုင်းပုံစံ၊ လွန်းကျင်းမျက်နှာစာရှေ့ ရေပြင်၏ ရေအနက် အခြေအနေပြ တိုင်းတာရေးရေပုံ၊ လွန်းကျင်း အနီး​ရေပြင် တွင် တည်ရှိနေသည့် မြစ်ကူးတံတား၊ ဆိပ်ခံ တံတား ၊ ဗော်ယာ၊ ရေအောက်ပိုက်လိုင်း စသည်တို့နှင့် လွန်းလမ်းကြောင်း အကြား အကွာအဝေး အနေအထား ပြပုံများ၊

၅။      သင်္ဘောကျင်း တည်ဆောက်ရာတွင် မှီငြမ်းပြုသည့်  (သို့ မဟုတ်) အတည်ပြုထားသည့် အခြေခံ ဒီဇိုင်းတွက်ချက် ထားသော စံချိန်စံညွှန်း၊ ဒီဇိုင်းပုံစံများ၊ ခံနိုင်ရည် စွမ်းအား တွက်ချက် သတ်မှတ်ထားသည့် အထောက်အထား စာရွက် စာတမ်းများ၊

၆။      သင်္ဘောကျင်းလုပ်ငန်းတွင် ရေယာဉ်များ လွန်းတင် လွန်းချ လုပ်ငန်းဆောင်ရွက်နိုင်သည့် Shipways ၊ Marine Railways ၊ Ship-lifts ၊ Floating Docks နှင့် Dry (Graving) Docks  စသည်တို့ ပါဝင်ရာ တည်ဆောက် ထားသည့် လွန်းကျင်း ဒီဇိုင်းပုံစံ အပေါ် မူတည်၍ လွန်းတင် လွန်းချ ဆောင်ရွက်နိုင်မည့် ရေယာဉ် အရွယ်အစား၊ တပြိုင်တည်း လွန်းတင်နိုင်သည့် ရေယာဉ် အရေ အတွက်နှင့် တန်ချိန်၊ လွန်းတင် လွန်းချ စက်ယန္တရားများ၏ ဆွဲ တင်နိုင် သည့် စွမ်းအား (Capacity) နှင့် စံချိန်စံညွှန်း အချက် အလက်များ (Specifications) ၊  (လေအိတ်အပါအဝင်)

၇။      သင်္ဘောကျင်းလုပ်ငန်းတွင်  ရေယာဉ်တည်ဆောက် ခြင်း ပြုပြင်ခြင်းလုပ်ငန်းများ၊ ရေကြောင်းဆိုင်ရာ  အဆောက်အအုံ (Marine Structure)တည်ဆောက်ခြင်း  ပြုပြင်ခြင်းလုပ်ငန်းများ နှင့် ရေယာဉ်ဖျက်ခြင်းလုပ်ငန်းများ ပါဝင်ရာ၊ မည်သည့်လုပ်ငန်း များဆောင်ရွက်မည် ဖြစ် ကြောင်း၊ ဆောင်ရွက်မည့် လုပ်ငန်း အရွယ် အစား၊ ပမာဏ နှင့် ကိုက်ညီသည့် နေရာ အကျယ်အဝန်း၊ အလုပ်ရုံ၊ သိုလှောင် ရုံ၊ ရုံး၊ စက်ပစ္စည်းနှင့် စက်ယန္တရား စာရင်း၊ စက်ပစ္စည်း၊ စက်ယန္တရား အမျိုးအစားအလိုက် စွမ်းဆောင်ရည်နှင့် စက်မှု ဆိုင် ရာ အချက်အလက်များ၊ Yard Lighting ၊Building Lighting ၊ Security Lighting နှင့် Sub-Station ရှိ လျှပ်စစ်ပိုင်းဆိုင်ရာ ပစ္စည်းစာရင်း၊ Electrical Diagram ပုံစံများ၊ လျှပ်စစ် စစ်ဆေး ရေး(EI)၏ စစ်ဆေးချက် အထောက်အထားများ၊

၈။      သင်္ဘောကျင်းလုပ်ငန်းတွင်  အပူပေးမီးပေးလုပ်ငန်း (Hot Work) အား  အဓိက  ဆောင်ရွက်ရသည့်အတွက် သက်ဆိုင်ရာ မီး သတ်ဦးစီးဌာန၏ စစ်ဆေးချက် အထောက် အထား၊

၉။        သင်္ဘောကျင်းလုပ်ငန်းတွင် ဆက်စပ်အသုံးပြုသည့် Chemical ပစ္စည်းများ၊ စက်သုံးဆီများ သိုလှောင်မည်ဆိုပါက သက်ဆိုင်ရာ အာဏာပိုင် အဖွဲ့အစည်းမှ ထုတ်ပေးထားသည့် သိုလှောင်ခွင့် လိုင် စင် အထောက်အထား၊

၁၀။    သင်္ဘောကျင်းလုပ်ငန်းနှင့် ပတ်သက်သည့် လုပ်ငန်းခွင် ဘေး အန္တရာယ်ကင်းရှင်းရေး အသုံးအဆောင် ပစ္စည်းများ စာရင်း၊ မီးဘေး ကြိုတင်ကာကွယ်ရေးသုံးပစ္စည်း များစာရင်း နှင့် လုပ်ငန်းခွင် ကျန်းမာရေး အထောက်အကူပြု အစီအမံ များ ထားရှိမှု အခြေအနေ၊

၁၁။    သင်္ဘောကျင်းလုပ်ငန်းဆောင်ရွက်သည့် ကုမ္ပဏီရှိ အင်ဂျင် နီယာများ၏ အချက်အလက်များ (မှတ်ပုံတင် အင်ဂျင်နီယာ လက်မှတ်ရှိကဖော်ပြ ရန်)၊ ကျွမ်းကျင်လုပ်သား များ၏ ကျွမ်းကျင် အမျိုး အစားအလိုက် ကျွမ်းကျင်မှု အဆင့်နှင့်ဦးရေ (ကျွမ်း ကျင်မှု လက် မှတ်ရှိက ဖော်ပြရန်)၊

၁၂။     လုပ်ငန်းအမျိုးအစားအလိုက် သက်ဆိုင်ရာ စည်ပင် သာယာ ရေးအဖွဲ့များ၊ အာဏာပိုင် အဖွဲ့အစည်းများမှ  ထုတ် ပေးထားသော လုပ်ငန်းလိုင်စင်များ၊

၁၃။    ယခင်တည်ဆောက်ထားပြီး၊ လုပ်ငန်းဆောင် ရွက်နေ သော သင်္ဘောကျင်းများ ဖြစ်ပါက၊ တည်ဆောက် ပြီးစီးသည့် ခုနှစ်၊ လုပ်ငန်းစတင်ဆောင်ရွက်ခဲ့သည့် ခုနှစ်တို့ကို ဖော်ပြရန်၊

၁၄။    သင်္ဘောကျင်း လုပ်ငန်းလုပ်ကိုင်ခွင့် လိုင်စင် သက်တမ်းတိုး လျောက်ထားသည့်အခါ၊ ယခင်ထုတ် ပေးထားသည့် လိုင်စင်အပြင် သက်တမ်းတိုး လျောက် ထားသည့်အချိန်၌ ယခင် လိုင်စင်ထုတ် ပေးစဉ်က တင်ပြ ခဲ့သည့် Facilities နှင့် ကွာခြားချက်ရှိပါက ကွာ ခြားချက်ကို ဖြည့်စွက် ဖော်ပြရန်၊

လျှောက်ထားရန်အဆင့်များ

License for Stevedoring Service

Information to be included in the application

1. The application form from the applicable port terminal (or application form to extend).
2. Name list of workers by gang of stevedoring services (gang no./ NRC no./father’s name).
3. Name list of truck driver (group number/registration number/father’s name).
4. Curriculum for the Ship Loader Driver Training Course.
5. Curriculum for Foremen and Commercial Managers (Ships).
6. Signaling Systems Syllabus.
7. Curriculum for occupational safety training.
8. Copy of port business permit.
9. A copy of the receipt proving payment of the approval fee for the seagoing vessel stevedoring business license issued by the Account Department of the Myanma Port Authority.

Regulations regarding this license

1. Sea-going vessel’s stevedoring permit shall be used only for sea-going vessels’ loading/unloading operations. It is not allowed to operate in domestic transportation.
2. The work must rigorously be completed in accordance with the terms and conditions listed in the paragraph as long as the licensee does not get an alternative written approval from the Myanma Port Authority.
3. Those seagoing vessels are permitted to operate stevedoring licenses for one (1) year only.
4. To obtain this approval, the permit holder(s) must adhere to the Myanma Port Authority’s letter dated July 25, 2013, reference no. Latha/1242/2013 (meeting minutes) and pay an annual fee of US$ 1,500 for the duration of the approval to the Myanma Port Authority.
5. When the license’s term expires, it will be terminated immediately.
6. This permission is nontransferable, even in the event that the permit holder(s) no longer possess the authority to manage the stevedoring of the aforementioned seagoing vessels. This license will be considered canceled if the stevedoring permit of such seagoing vessels cannot be used for the purposes specified above.
7. Must comply with the Port Workers Act and Labor Inspection Laws issued by the Ministry of Labor.
8. If the permit holder(s) violates any of the rules mentioned above, this permit will be forfeited to the Ministry of Transportation. The Myanma Port Authority may suspend (or cancel) at any time, and if it is necessary to do so, the licensee(s) must immediately cancel it by their own plan.
9. If mid-water stevedore service is required, the responsible party shall be the relevant terminal at the berth.
10. In order to ensure the safety of stevedore service and occupational safety of sea-going vessels, inspection officers from the Myanma Port Authority shall periodically inspect and follow the recommendations based on the inspection findings.
11. Employees and workers appointed by the organization that have the right to work are injured; The Myanma Port Authority shall not (absolutely) deal with matters of compensation for disability and death.
12. When applying for work permit extension, the application must be made one (1) month before the expiration date.
13. A fine of 100,000 Kyats is imposed if the renewal of the cargo/cargo business license of sea-going vessels is not done in time and exceeds the deadline within 1 month (30 days). If it exceeds 1 month (30 days), two hundred thousand kyats; If it exceeds 2 months (60 days), 300,000 Kyats. Ten thousand Kyats if more than 3 months (90 days) and after 4 months (120 days) the work permit will be terminated.
14. As for private terminal operating port services, if they operate without business permits, according to Sections 83 and 90 of the Myanma Port Authority Law, business operators and those who break the rules must be prosecuted according to the Myanma Port Authority Law.

 

Services for dredging business in water areas in constructions of
accomplished and ongoing wharves

It has to be applied to get the necessary depth of water for the construction of accomplished and ongoing international and coastal wharves in port area.

Service Fee

For dredging business, lending fee for digging machine is 1200 MMK for 1 square meter and 5% of tax have to be paid  to Department, Myanmar Port Authority by Port companies and necessary engine oil, lubricant and other related materials have to be  provided to Hydraulic Session, Civil Engineer Department, Myanmar Port Authority.

Required Documents

1. Application letter for dredging business in related wharves to the Director of Myanmar Port Authority
2. Water map of measured depth of water for water area of wharf or location of port

Steps to apply

Step 1 –        Application letter has to be submitted  to Myanmar Port Authority  for dredging business in related wharves, to Director of Myanmar Port Authority and water map of measured depth of water for water area of wharf or location of port.

Step 2 –       The authorities of Myanmar Port Authority will inspect  the situation of the place where the dredging business is to be  performed.

Step 3 –       By assessing  the amount of silt dredged according to water map submitted by  the wharves companies , Civil Engineer Department, Myanmar Port Authority shall inform/submit the negotiation letter for lending fee and tax to Department of Myanmar Port Authority.  Requirement of  necessary engine oil, lubricant and other related materials will be submitted  to Hydraulic Department of Myanmar Port Authority.

Step 4 –        After the payment of  tax to Myanmar Port Authority by the Wharves’ Company, the listed service/business will be performed  depending on the situation of weather, strength of dredge vessels, departmental dredging business and private dredging business.
